All services may be customized based on client requirements and agreed upon in separate contracts or statements of work.
2. Eligibility

3. Intellectual Property
Polygon AI retains ownership of all proprietary methodologies, frameworks, and pre-existing intellectual property.
Workshop materials, presentations, and educational content remain the property of Polygon AI.
Custom solutions developed specifically for clients become the property of the client unless otherwise agreed in writing. However, Polygon AI retains the right to:
- Use general knowledge, techniques, and methodologies gained during the engagement
- Develop similar solutions for other clients without using client-specific confidential information
4. Confidentiality & Data Protection
We are committed to protecting your data in compliance with Swiss data protection laws and GDPR where applicable:
- Client Data: All client data provided during engagements is treated as confidential and used solely for delivering agreed services.
- Security Measures: We implement appropriate technical and organizational measures to protect data against unauthorized access, alteration, or disclosure.
- Data Ownership: Clients retain ownership of their data. We do not use client data to train models for other clients unless explicitly agreed.
For clients requiring formal data processing agreements, these will be established as separate contractual documents.
Ideas, suggestions, or feedback shared during workshops may be used by Polygon AI for improving future offerings, provided no client-specific confidential information is disclosed.
5. Payment Terms
Payment terms are as follows:
- All fees are quoted in Swiss Francs (CHF) unless otherwise specified
- Payment terms are typically 30 days from invoice date unless otherwise agreed
- Late payment may result in suspension of services until payment is received
Workshop and educational services are typically paid in advance or upon completion
6. Service Availability & Performance
While we strive to provide high-quality services, we cannot guarantee specific outcomes or results from AI implementations.
Polygon AI is not liable for:
- Decisions made by clients based on AI recommendations or insights
- Third-party service interruptions affecting AI systems we develop
- Performance variations due to changes in underlying AI technologies or data quality
Workshop attendance and engagement levels may vary and are partially dependent on participant involvement.
7. Warranty Disclaimer
Services are provided 'as is' without warranties of any kind, including but not limited to:
- Merchantability or fitness for a particular purpose
- That AI solutions will meet all specific business requirements
- Non-infringement of third-party rights
- Complete accuracy of AI predictions or recommendations
8. Limitation of Liability
Polygon AI's liability is limited to the greatest extent permitted by Swiss law. We are not liable for:
- Indirect, consequential, or incidental damages
- Lost profits, business interruption, or loss of data
- Any amount exceeding the fees paid for the specific service giving rise to the claim
9. Client Responsibilities
Clients are responsible for:
- Providing accurate and complete information necessary for service delivery
- Ensuring they have rights to any data or systems they provide access to
- Compliance with applicable laws and regulations in their use of our services
10. Termination
Either party may terminate ongoing services with appropriate notice as agreed in individual contracts.
Upon termination:
- All confidential information must be returned or destroyed
- Outstanding fees become immediately due
- Clients retain rights to work products specifically developed for them and paid for
11. Changes to Terms
We may update these terms periodically. Continued use of our services after changes constitutes acceptance of new terms.
12. Governing Law
These terms are governed by Swiss law. Any disputes will be resolved in Swiss courts.
